<p>Yes, overtime is subject to the same taxes as regular pay. Taxes charged on overtime include federal income tax, FICA (Social Security and Medicare) tax, and FUTA (federal unemployment) tax, as well as state income tax and state unemployment tax, if applicable. The ‘No Tax on Overtime’ deduction isn’t included on your pay stubs or your W-2, but instead, it’s taken by employees on their federal income tax return (Form 1040), to offset overtime pay reported on the Form W-2 given to them by their employer.</p>


Is there tax on overtime?

<p>Yes and no &#8211; there are still federal income taxes on overtime, but only if you make more than $12,500 as a single filer or $25,000 if you’re married and file jointly. However, other payroll taxes such as FUTA (Federal Unemployment Tax Act) tax, FICA (Social Security and Medicare) tax, and state income taxes &amp; state unemployment taxes (if applicable) are not <a href="https://onpay.com/insights/no-tax-tips-what-employers-should-know/">impacted by the ‘No Tax on Tips’ law</a> and must will still be applied to overtime.</p>


Will there be no tax on overtime?

<p>Exempt workers are not legally entitled to overtime pay under the Fair Labor Standards Act (FLSA) &#8211; which is why they’re considered ‘exempt’ &#8211; and therefore the ‘No Tax on Overtime’ deduction does not apply to them. To be considered exempt, employees must meet higher minimum wage requirements and generally must perform administrative, executive, or professional tasks (C-suite exec, law, accounting, doctor, engineering, etc).</p>


Can exempt workers claim no tax on overtime deduction?

<p>While the One Big Beautiful Bill (OBBB) was passed on May 22, 2025, the ‘No Tax on Overtime’ deduction is retroactive and begins on January 1, 2025. As a result, business owners with employees who receive overtime must either retroactively calculate the amount of overtime premium payments received by each employee, or “approximate” the amount of qualifying overtime using a “reasonable method”, which will be defined by the Secretary of the Treasury at some point in the future.</p>


When does no tax on overtime start?

<p>This law will require employers to include employees’ overtime premium payments &#8211; the portion of overtime that is eligible for the deduction &#8211; in a dedicated new box on Form W-2. This will allow employees to easily understand the deductible portion of their overtime pay. There will also be a new “above the line” deduction on Form 1040 &#8211; likely on Schedule 1, Part II “adjustments to income” &#8211; where qualifying employees will input their ‘No Tax on Tips’ deduction, which will reduce their taxable income.</p>
